Every year, tens of thousands spend time in halfway houses
The BOP usually cannot allow a prisoner to serve more than six months in home confinement or 10 percent of the entire term of imprisonment. A prisoner serving a 40-year sentence would only be eligible for four months of home confinement since it is 10 percent of the total sentence and less than the alternative six months. But many prisoners transition from prison to halfway housing and from there to home confinement before they are released into the community. Placement in a RRC/halfway house is one alternative to pretrial detention for individuals whose appearance cannot be reasonably assured and/or who may pose a danger to the community under less restrictive conditions. Placement in a halfway house as an alternative to detention is most effective in conjunction with pretrial services supervision. Officers can also monitor the individual’s progress through effective supervision practices and inform the court if the situation improves and a less restrictive alternative is appropriate.

For the purpose of this briefing, however, we are focusing on “Halfway Houses in the Criminal Justice System”– which are state or federally contracted facilities for people leaving state or federal incarceration. State-licensed halfway houses can be referred to by a variety of terms, like Transitional Centers, Reentry Centers, Community Recovery Centers, etc. These facilities work with corrections departments to house individuals leaving incarceration, often as a condition of parole or other post-release supervision or housing plan. Over the past several weeks, I have received numerous e-mails and calls from different individuals concerning federal halfway house placements that have been reduced significantly—or denied entirely—by the Federal Bureau of Prisons (“BOP”). While in theory, they are the same; a sober living home is usually a private facility that can be fancier than a halfway house. Residents are all going through a similar process, and the staff creates a sense of structure.
How Long can an Inmate Spend in Residential Reentry Centers?

Transitioning suitable inmates to home confinement also helps address RRC capacity issues and ensures that more inmates are afforded RRC service.
It is the goal of the Bureau of Prisons to help all prisoners transition into life on the outside, but prisoners do not have a right to demand to serve time in a halfway house.
